How Long Does the VA Appeals Process Take?

If you are a Veteran, you may be wondering how long it will take you to get a decision on your VA disability claim. The answer will depend on the complexity of the case, the evidence, and your choice of appeal.

You have three options to pursue an appeal with the Board of Veterans' Appeals. The fastest method of getting a decision is the Direct Review docket, which only involves new or complete files. If you have a complete file, you should expect to receive your decision in four05 days. However, you will have to provide new evidence to the VA before receiving the decision.

If your case is not resolved by the Direct Review docket, you can also opt for the hearing docket. This option is best for Veterans who want to appear before a VA law judge to argue their case. Most appeals that choose this option are conducted over video. When you appeal with the hearing docket, you will have to wait up to two years to get a decision. The amount of time it takes to receive a rating decision or hearing docket decision will also depend on the number of claims and the availability of evidence. If you are appealing an unfavorable decision, you may have to submit additional evidence or submit a notice of disagreement. The VA is required by law to process cases in order. If you are appealing a rating decision, you will need to wait until the board reviews the evidence. If the board determines that you have been unfairly denied, you will be given a second chance. You can also ask the VA to remand your case to the board.

The VA Board of Veterans' Appeals is a new system that was introduced in 2016. It is intended to provide more flexibility and streamline the claims and appeals process. It was created by a group of veterans' service organizations and advocacy groups. The VA convened a legislative staff to help them write the law.

The Board of Veterans' Appeals is a federal agency, and it has a staff of 1,250 full-time employees. In 2019, the Board decided 95,000 cases. The average time for a hearing is 18 months. The board has hired 15 new VLJs in 2022. The number of claims and appeals filed with the Board has been increasing. In 2010, the board made decisions on 35-38,000 cases. This means that more and more Veterans are filing appeals with the Board every year.

When you appeal to the Board of Veterans' Appeals, you will receive a transcript of the hearing. You can submit evidence online through the QuickSubmit application. You must submit your evidence within 90 days of submitting an appeal. The VA will send you a survey after your written decision. If you do not receive a decision in 68 days, you can appeal to the higher-level review lane. The VA will notify you if it needs more evidence or will need to remand your case.
